On July 1 of next year, same-sex couples applying for a marriage license in Indiana will have committed a felony punishable by 18 months in prison an a $10,000 fine. The new crime stems from the revival of a1997 law forbidding false information on a marriage license as a Class D felony. It will also make it a Class B misdemeanor -- punishable by up to 180 days in a jail and a maximum fine of $1,000 -- for clergy, judges, and others to perform a same-sex marriage.

The New Civil Rights Movement explains how the new rule works:

Because Indiana marriage license forms have a space for ?male applicant? and ?female applicant?, any same-sex couple filling out the form would automatically violate the law. The harsh penalties Indiana lawmakers have approved make it difficult for protest movements like the Campaign for Southern Equality?s ? We Do? Campaign, which encourages same-sex couples to apply for marriage licenses as a protest in states that prohibit same-sex marriages.

Same-sex marriage is already illegal in Indiana, but legislators are contemplating adding a ban in an amendment the state's Constitution. The vote will be held in the January-March 2014 legislative session.

What happened to freedom of religion? They are making it a felony for willing churches and ministers to officiate a marriage ceremony for gay couples.

This is an outrageous over reach of the state. This further goes to show that these idiotic bigots care nothing for the peoples freedom of religion. This is simply a campaign of hate and intolerance. Nothing more nothing less. They are attempting to quell the peoples protest and going far further this time, they are marching right into the churches and dictating what they can and can not do, banning churches from holding religious ceremonies.

Sources: Ex-swim coach held in Mexico

WILLIAMSON COUNTY, Tenn. - Former Fishers swim coach Ken Stopkotte has been captured in Guadalajara, Mexico, and is facing extradition to the United States, multiple sources confirmed to Call 6 Investigator Kara Kenney.

Authorities had been looking for Stopkotte for several months.

Stopkotte was arrested Feb. 20 by Franklin, Tenn., police on suspicion of stealing checks from the First Presbyterian Church. He was supposed to appear in court April 9, but did not show up.

The former swim coach was also supposed to appear in court April 12 on charges stemming from three additional cases involving domestic assault, theft of over $1,000 and false reports to police.

As the Call 6 Investigators reported last month, federal records show the United States Secret Service has filed a warrant to seize at least one of his bank accounts.

In an affidavit signed June 5, USSS special agent Eric Fehlman alleged Stopkotte stole nearly $100,000 in checks from more than a dozen churches in Tennessee and deposited them into his own account for personal gain.

Investigators said bank records show between Aug. 20, 2012 and Nov. 6, 2012, Stopkotte was going through church mailboxes, taking checks and depositing them into his own account through ATMs.

A police report from Franklin, Tenn., police indicated that the domestic violence charge came from an October 2011 incident involving his now estranged wife, Rebecca Stopkotte, who reported that Ken Stopkotte punched her in the back and squeezed her neck area.

In 2010, Stopkotte was charged with stealing $17,000 in Fishers pool rental money, but the Hamilton County prosecutor dismissed the charges in March 2012.

Stopkotte, who served as the Fishers High School swim coach from 2006 to 2010, filed a defamation lawsuit Jan. 28, 2013, against Hamilton Southeastern Schools and Mel Goldstein, of the YMCA.

In February, Stopkotte told Kenney that the school district and Goldstein falsely accused him of theft, which negatively impacted his life.

"It's been a devastating experience," Stopkotte said, adding that it's difficult to find work. "I've had to undergo thousands of dollars of counseling. There's not a day that goes by that I don't think about what happened."

In addition to serving at Fishers High School, Stopkotte also worked as the coach of USA Swimming-sanctioned swim club Fishers Area Swim Tigers (FAST).

Stopkotte was in charge of renting the Fishers High School pool to community groups, including YMCA's Indy Swim Fit, a program run by Goldstein.

Stopkotte spoke to RTV6 in 2009 and ABC?s 20/20 in 2010, blowing the whistle about sexual abuse within the sport of swimming.

He resigned in August 2010 from FAST and Fishers High School amid allegations he altered times for swim meets. USA Swimming banned him for two years and Indiana swimming banned him for five years.

Stopkotte told RTV6 in February the Hamilton Southeastern school district should pay and apologize for falsely accusing him.

"I think people need to be accountable for telling the truth," said Stopkotte in an interview with Kenney in February.

The U.S. Attorney?s Office has not yet filed criminal charges against Stopkotte and would neither confirm nor deny the existence of a criminal investigation.

"If a criminal investigation was occurring, I suppose you could see an indictment or other charging instrument issued in the future," wrote David Boling, spokesman for the U.S Attorney?s Office in Nashville Tenn., in an email to RTV6.

Chicago teens find 'preppy' sports offer different kind of athletic deliverance

The Chicago Sanitary and Ship Canal is the last place you'd expect to find anyone practicing a signature sport of the Ivy League, yet on a gray July evening, here they were: two dozen city kids in racing boats sculling past graffiti-bombed factories and fields of rubble.

Among the oarsmen was Jocelyn Duran, 14, a quiet and diminutive girl from Little Village whose life, thanks to her involvement with the sport, is about to change dramatically.

She has received a full scholarship to attend Northfield Mount Hermon, a $50,000-a-year boarding school nestled in the hills of western Massachusetts. Rowing helped her to win over the admissions office, but her coach hopes the sport will carry her even further.

"Rowing operates in this really interesting place that maybe other sports don't," said Montana Butsch of the Chicago Training Center, a nonprofit group that uses the sport to try to improve the prospects of working-class teens. "There are no professional (teams), but there is access to high-level education and (social and business) networks, really interesting people and experiences. That's stuff you can parlay into the rest of your life."

Football, basketball and boxing have long been portrayed as tickets out of low-income neighborhoods, giving young people dreams of college scholarships or pro careers. But in recent years, other sports have begun to offer a different vision of athletic deliverance.

They are sports such as lacrosse, squash and sailing, pastimes generally associated with the wealthy and privileged. Boosters say they offer an old-fashioned kind of social uplift by creating the habits, friendships and educational opportunities that can help teens connect with successful people.

"They have the opportunity to build social capital, and that's a really critical thing," said David Kay of METROsquash, a program that trains Chicago Public Schools students in the hallmark sport of Wall Street. "That really breaks down barriers, being able to play with a colleague or friend. It's really a great tool for building relationships. It will provide introductions for them throughout their lives."

METROsquash, which formed in 2005, combines athletic instruction with academic tutoring. The combination has helped some students gain admission to well-regarded charter schools and prestigious out-of-state boarding schools, Kay said.

A newer program, Outreach With Lacrosse & Schools, aims to have a similar impact. Sam Angelotta, who teaches at St. Malachy School on the Near West Side, uses the sport to connect children with lacrosse players at leading universities such as Northwestern and Notre Dame.

"The main goal is to get them to start thinking about being a student-athlete versus just an athlete," Angelotta said. "That exposure to a college campus gives them a reason to want to achieve in the classroom, to want to go to college."

There's no overt academic angle with the junior sailing classes offered by the Judd Goldman Adaptive Sailing Program, but Peter Goldman, the group's president, said it gives at-risk young people "a more worldly outlook ? more exposure to what's going on."

They sail small watercraft in city lagoons with the goal of graduating to big boats on Lake Michigan; some go on to become sailing instructors for the Chicago Park District. Time spent on the water can also pay off later with social or business connections, Goldman said.

But when it comes to business success, there's no sport like rowing ? or at least, that was the finding announced last summer by the management consulting firm Bain & Co.

Bain partner Patrick Manning, a silver medalist in rowing at the 1992 Olympics, looked at Olympic medalists from the United States and the United Kingdom and found that 8 percent of rowers went on to become investment bankers, law firm partners, corporate board members and the like. No other sport came close.

Manning noted that rowers tend to come from affluent families and have high levels of education, but added that the demands of the sport are similar to those of business: Those who do well defer gratification, work hard and forsake individual glory for the sake of the team.

Butsch came to a similar conclusion after rowing his way through Loyola Academy, University of Pennsylvania and Oxford University. He said he founded the Chicago Training Center in 2007 to offer those lessons to children from underprivileged backgrounds.

"Rowing teaches you how to foster friendships, deal with teamwork at a high level, learn to prioritize and set goals and achieve them," he said. "That's transferable to anything else in life ? schoolwork, family life, friendships, all of that."

Almost all of the program's 50-some athletes, who do not pay to participate, come from Chicago's South and West sides. Some practice close to year-round, with indoor workouts at the Gage Park field house and water sessions along the canal; they're training for the Chicago Sprints, a regatta in the Lincoln Park Lagoon next weekend.

The center recently hired an adviser to help the children boost their classroom skills, but some have already seen rowing help them academically: Butsch said he helped two girls strengthen their transcripts with a fifth year of high school at Phillips Exeter Academy in New Hampshire.

His goal is to see some of his athletes make it to the Ivy League, and Brian Bahena, 17, a rising senior at UNO Garcia High School in Archer Heights, might be the first. He has rowed for three years, and with Butsch's encouragement, plans to apply to Columbia and Brown.

Texas Senate gives final passage to abortion bill delayed by filibuster

Despite Wendy Davis' dramatic filibuster delaying Texas' abortion bill, the Republican-dominated Texas legislature is expected to support the measure which would ban most abortions for women more than 20 weeks pregnant. Just this year, 17 states passed new measures impacting abortion. NBC's Kate Snow reports.

Texas legislators overturned a temporary victory by state Democrats and standard bearer Sen. Wendy Davis, passing a bill late Friday that puts new restrictions on abortion procedures.

The bill passed the Republican-controlled Senate just before midnight, two weeks after the Legislature failed to put the restrictions to a successful vote in its first special session. The bill would ban most abortions past 20 weeks of pregnancy, place new requirements on which facilities could perform the procedures and limit a woman?s ability to induce an abortion by taking a pill.

Abortion rights advocates, including Planned Parenthood of Texas, have said that the new law would effectively shut down all but six of the facilities where abortions are performed in the state.

Pro- and anti-abortion activists flooded the Texas Capitol on Friday afternoon, setting the stage for a dramatic ideological showdown. Abortion rights advocates wearing orange were holding gynecological devices and signs, while anti-abortion advocates dressed in blue carried images of fetuses and Bible verses, according to The Associated Press.


Twenty-one amendments were offered, debated and rejected. As debate progressed, reporters inside the chamber said protesters could be heard chanting outside, and some protesters who were in the gallery?were removed after outbursts.

As the time ticked toward midnight, senators offered passionate arguments on either side.

Gov. Rick Perry had made passing House Bill 2 a priority and said he will sign it into law.

In a statement after the bill passed, Perry said: This legislation builds on the strong and unwavering commitment we have made to defend life and protect women's health. I am proud of our lawmakers, and citizens who tirelessly defended our smallest and most vulnerable Texans and future Texans."?

Democrats in the legislature have said that while there was little they could do to keep the bill from passing, they plan to challenge it in federal court.

?We do not have the numbers to stop it,? said Democratic Sen. Royce West of Dallas, according to The Associated Press. ?As soon as it?s signed by the governor, it will be challenged ? we believe the whole bill is unconstitutional.?

Texas is only one of several states looking to tighten rules for abortions.

North Carolina's House passed a bill Thursday that directs state regulators to change standards for abortion clinics to bring them in line with more regulated outpatient surgical centers.

Missouri's governor Friday let a bill become law without his signature that requires doctors to be in the room for the initial dose of a drug used in medication abortions.

Wisconsin?s governor signed into law last week a measure similar to Texas' that forces abortion doctors to have admitting privileges at nearby hospitals. That law was blocked by a federal judge.

The biggest fireworks have come in Texas. Last month, GOP lawmakers were prevented from carrying out a vote on House Bill 2 as their first special session came to an end after Davis delivered an 11-hour filibuster that was cut short when state senators ruled she had committed three rules infractions. Raucous protests from Davis supporters in the gallery prevented lawmakers from carrying out a valid vote on the bill.

Security was tightened before the final vote Friday. Dozens of state troopers surrounded the gallery and monitored the hallways Friday, according to the AP.

Troopers inspected bags of people streaming into the halls of the capitol. Senate Sergeant-At-Arms Rick DeLeon said no props would be permitted in the gallery, including tampons, perfume bottles, and moisturizers, the AP reported.

Sen. Kirk Watson of Austin, the leader of the legislature?s Democrats, said he stepped in to prevent troopers from confiscating feminine hygiene products from women hoping to view the debate, according to the AP.

The fight over the bill has drawn national attention from abortion rights advocates disturbed by the spread of new restrictions, as well as anti-abortion activists who say the new law would protect the health of mothers and fetuses.

Former contender for the GOP presidential nomination Rick Santorum appeared in Austin on Thursday, and said that ?Texas is the center of the pro-life debate in the country right now,? according to Reuters.

Go-ahead on sewage bids miffs Esquimalt mayor

Greater Victoria?s sewage treatment plant has officially gone to tender, just days before Esquimalt decides whether to approve rezoning to even allow building on the planned site.

The Capital Regional District?s civilian sewage commission, made up of unelected technical experts, issued the formal Request for Proposals for a $230-million treatment plant at McLoughlin Point in Esquimalt on Friday afternoon.

It?s the first step in the $783-million sewage project, which also includes a future biosolids facility, pump stations and piping.

The lengthy request assumes Esquimalt council will vote in favour of rezoning McLoughlin Point for a treatment plant during a planned meeting Monday.

Hundreds of angry Esquimalt residents crowded two public hearings this week to urge council to reject the proposal, or at least seek additional amenities to soften the plant?s blow to the community.

?We knew that the RFP was coming out,? said Esquimalt Mayor Barb Desjardins.

?We have no control over the actions of the CRD ? particularly when they decide to release documents.

?We are disappointed that the CRD chose to release the RFPs before council had an opportunity to deal with the bylaws. They knew that council intends to deal with the bylaws on Monday.?

If Esquimalt rejects the zoning, the CRD could appeal to the provincial government to override the decision.

Commission vice-chairman Colin Smith said the Request for Proposals process will be lengthy enough to include any zoning issues or design guidelines raised by Esquimalt council.

?This is a long process,? Smith said.

?We?re already later in getting the RFP out than we?d like to be, to meet the timeline we are mandated to ? at this point, unless somebody tells us the site is no longer the site, and the senior governments want to give us an extension of time to complete the project, and potentially additional budget, we are mandated to move forward in a business-like manner.?

Three consortia have already been shortlisted by the CRD to bid on the request: Capital Clear, Harbour Resource Partners and PCL Partnerships.

The CRD commission will select a winning bidder by Feb. 28, 2014, based on criteria that include operating costs, sludge costs, capital-maintenance costs and a triple bottom line.

The companies must bid using ?proven technology? such as biologically aerated filter treatment, according to the document.

?If they can show us, not pie in the sky, but a plant somewhere in the world that is working at significant capacity and has for a significant period of time, they could bring that forward,? Smith said.

?We encourage them to bring that forward.?

The document also encourages innovation through resource recovery, automation, greenhouse gas reduction and other economic, social and environmental ideas.

There should be no odours in a well-designed plant, and the bidders will have to submit design mock-ups that include both the CRD and Esquimalt?s design criteria, Smith said.

?A big ugly box would not meet Esquimalt?s design guidelines and [would] not be accepted.?

The request caps plant costs at $230 million. There will be a $60-million holdback so a company has ?skin in the game? until the CRD is confident the plant works through a 90-day acceptance test and a two-year performance period, Smith said.

There?s also a $20,000-a-day penalty for unexcused delays.

Smith said the request terms are standard for a sewage project of this size.

UK rejects public inquiry into ex-KGB spy's poisoning

LONDON (Reuters) - The British government has turned down a request for a public inquiry into the murder of a former Russian spy in London which could have revealed whether Moscow was behind the killing, a coroner announced on Friday.

Coroner Robert Owen had asked ministers to hold an inquiry, declaring his own investigation flawed after bowing to ministers' requests for some material to be kept secret which could have shed light on Russia's suspected involvement.

Alexander Litvinenko, 43, died in 2006 after drinking tea poisoned with a rare radioactive isotope, polonium-210, in a plush London hotel. From his deathbed he accused Russian President Vladimir Putin of ordering his murder, a charge Russia has repeatedly denied.

Anglo-Russian relations deteriorated to a post-Cold War low after British police and prosecutors said there was enough evidence to charge two former KGB agents, Andrei Lugovoy, who denies any involvement, and Dmitry Kovtun, with murder.

Prime Minister David Cameron has made a concerted attempt to mend diplomatic and business ties since coming to power, and Litvinenko's family have accused Britain of wanting to cover up embarrassing information to protect lucrative trade deals.

"It is a political decision of the British government," Litvinenko's widow Marina told reporters after the news was broken at a pre-inquest hearing at London's High Court. Her lawyers are now seeking a judicial review.

Under British law, inquests conducted by coroners are held when a person dies unexpectedly to determine the cause of death.

The former KGB agent had been granted British citizenship and become a vocal critic of Putin. Previous pre-inquest hearings have heard he had worked for Britain's MI6 intelligence service, and that the government held evidence which established a "prima facie case" Russia was behind his murder.

Owen, a senior judge acting as coroner, agreed in May to keep secret material which, if aired at an inquest, could undermine trust in the British government or "cause real harm to the UK's international relations". He concluded the only way to learn the truth was through a public inquiry which could examine such information in private if needed.

But looking visibly shocked and angry, Owen said he had been given just 45 minutes notice prior to Friday's hearing that the government had rejected his inquiry request.

"RUSSIAN STATE RESPONSIBILITY"

"For the avoidance of doubt, I should say that I regard investigation of the 'preventability' and 'Russian State responsibility' issues as being of central importance in this case," he told the court.

"It is a highly exceptional situation when the victim of what appears to have been a murder is interviewed by police before he dies and makes a public statement in which he names those whom he suspects of being responsible for his death."

He said there was now no chance his inquest could start on October 2 as planned due to numerous legal hurdles, not least an application from Litvinenko's lawyers for a judicial review.

Neil Garnham, the lawyer for the Home Office (interior ministry), said the decision had been made after "careful consideration" and the reasons would be disclosed next week.

He said the possibility of an inquiry would be "kept under close and careful review" as the inquest progressed.

But Ben Emmerson, lawyer for Litvinenko's widow Marina, described the government's treatment of his client and her family as "shabby" and showing "utter contempt" and said he was confident senior high court judges would overturn the decision.

Marina Litvinenko said she was shocked and disappointed but would fight on. "I still have a very long way to get justice," she told reporters. "I believe again ... we will get justice."

Android this week: Sony Xperia Z reviewed; LG?s G2 teased; HTC One now dual boots

The next wave of Android hardware seems to be building and this week, I reviewed the latest from Sony. The company?s Xperia Z with LTE for T-Mobile debuted on Wednesday and is available from the carrier this coming on July 17 for $99 down and 24 equal payments of $20. The handset uses a 5-inch 1920 x 1080 display. Some may be put off by Sony?s choice of a slightly older chip to power the Xperia Z, but in my testing, it was a non-issue.

Instead of using a Qualcomm Snapdragon 600 like other currently available flagship handsets, Sony inserted a Snapdragon S4 Pro. This quad-core, 1.5 GHz chip is from last year. With the 2 GB of memory, however, the Xperia Z held its own against its peers, the Galaxy S 4, HTC One and LG Optimus G Pro. Yes, the phone benchmarks as a slower device, but I didn?t experience any noticeable lags or slowness by comparison.

Fairly unique to the Xperia Z is its resistance to dust and water. Yes, this phone can take a drop in the pool: I checked! You can also take photos and videos underwater but not for hours. The Xperia Z can withstand 30 minutes in up to 1 meter of water. Sony lightly skinned the Android software so the interface isn?t as overpowering as Samsung?s TouchWiz or HTC?s Sense interface. And in areas with T-Mobile LTE coverage, the mobile broadband speeds are quite good. T-Mobile introduced several new LTE markets this week so your area may now be lit up.

While Sony is outing new phones, LG is only teasing its next device. We shouldn?t have to wait long though: On August 7, LG is holding a press event where it will debut the LG G2; the company?s first handset with a Snapdragon 800 chip. This is top-of-the-line silicon from Qualcomm and boasts faster performance as well as vastly improved support for video and still imagery. It?s likely the G2 will be capable of 4K video capture at 4,000 x 2,000 pixels. With all that power under the hood, the handset will surely have at least a 1920 x 1080 display and be 5-inches in size or greater.

HTC One Google Edition boxThis week also brought good news for HTC One owners, making me happy since I may become one of those soon. Paul O?Brien of MoDaCo showed his latest work in progress for the HTC One: A dual-boot option that lets you run either the HTC Sense software or the stock Google Android environment found on the Google Experience version of this phone. O?Brien is also working on integrating some of the better Sense bits, such as the camera app, into the stock Android software.

For now, however, you can boot into one or the other versions. And the two environments share the same data store. That means apps you add when running Sense, for example, appear when you boot into pure Android, and vice versa. The same holds true with your account settings, media and any other data. Analysis: antitrust ruling could temper Apple?s revolutionary zeal

A federal judge?s ruling on Wednesday that?Apple violated antitrust laws in its dealings with book publishers?may limit the ways in which the company strikes deals in other industries going forward.

?Apple will be under more scrutiny,? both from the US Department of Justice and other government regulatory agencies, said Jerry Reisman, a partner and antitrust attorney in the Garden City, New York, law firm Reisman, Peirez, Reisman and Capobianco.

?This is a successful civil prosecution of an antitrust case against Apple,? Reisman said. ?It could possibly lead to other further investigations in which Apple is engaged in anti-competitive pricing.?

As a result, Apple may be more cautious about entering into other markets with the same zeal.

The ruling, if it stands, ?ties Apple?s hands to some extent,? said Keith Hylton, a professor at the Boston University School of Law. The company may want to develop other new features for its products, much like it developed the iBookstore for the iPad. This ruling ?introduces a risk that it would face in doing something like that,? Hylton said.

Judge Denise Cote of the US District Court for the Southern District of New York found Apple guilty of violating Section 1 of the Sherman Antitrust Act in a ruling issued on Wednesday. The plaintiffs ? the US Department of Justice along with 33 states and US provinces ? convinced the court that Apple engaged in ?horizontal price fixing? when making deals with the five largest book publishers.

In 2012, the DOJ and 33 states and US territories brought a lawsuit charging that Apple and five of the largest book publishers in the US conspired to raise prices in the ebook market in 2010, in an effort to stop Amazon from pricing their best-selling electronic books at US$9.99.

Apple signed deals in 2010 with five of the six largest book publishers ? Hachette, HarperCollins, Macmillan, Penguin and Simon & Schuster ? to sell electronic books in an agency model. Under such an agreement, the publishers would set the prices of ebooks, chosen from a set of pricing tiers Apple formulated. Apple got a fixed 30 percent cut of each sale through its iBookstore, which would debut on the about-to-be-launched iPad.

Apple also stipulated that publishers would give Apple ?Most Favoured Nation? pricing, which would guarantee that the publishers would sell ebooks to Apple at a wholesale rate of 70 percent of the lowest retail price of that book, thereby guaranteeing that Apple could offer the books at the same cost of its competitors.

Immediately after the contracts took effect in April 2010, and publishers moved all their retailers to the agency model, prices of ebooks offered by both Amazon and Barnes & Noble increased almost immediately.

Apple ?provided the Publisher Defendants with the vision, the format, the timetable, and the coordination that they needed to raise ebook prices,? wrote Judge Cote in the?160-page opinion.

All the publishers settled out of court, leaving Apple to defend its practices by itself.

Although legal experts agreed that the case is not nearly as significant as the antitrust case that the DOJ brought against Microsoft in 1998, it will have an effect on Apple, given its dominant role in the market of electronic devices and in certain forms of media, such as recorded music sales. ?Because Microsoft?s case concerned such a wide-ranging scope of conduct, it was bigger. But few cases are that big,? said Ankur Kapoor, an antitrust lawyer for the law firm Constantine Cannon.

Apple vowed to appeal the decision, but opinion is divided over whether it can succeed at that.

That Cote has written a comparatively long and detailed opinion may hamper Apple?s ability to remake its case. ?That limits the freedom the appellate court has to modify a district court?s decision,? Hylton said.

Others see more optimistic prospects for Apple. Despite the copious amount of evidence?it presented to the court, the DOJ ?did not prove what they set out to prove, that Apple conspired with the publishers to raise ebook prices,? Kapoor said.

?The most that the Government could show was that Apple pushed the publishers to move to an agency model and had the publishers do the same with Amazon. But that is a different agreement,? Kapoor said. ?On balance, there is too much contradicting [evidence] that Apple conspired with the publishers to raise prices.?

In the meantime, Apple?s lawyers also may be defending the company in other courts.

The European Union, which has come down even harder on monopolistic practices than the US, may now be spurred on to investigate Apple as well, Reisman said. Because Apple commands such a large percentage of the markets for tablets and smartphones, the DOJ or the European Union could investigate how Apple interacts with its suppliers or with its retailers.

The ruling will also pave the way for private class-action suits, Hylton said. ?There is a lot of room for plaintiffs to seek damages now,? he said.

?Apple is sitting on a lot of money already, which means Apple may be able to pay the damages, and a lot of lawyers will have incentives to sue Apple,? Hylton said.

The ruling also sends a message to other companies, now that the DOJ successfully prosecuted an antitrust case.

?Be very, very careful with communications when you are negotiating industrywide deals,? Kapoor said. ?The DOJ will examine your communications under a microscope.?

Perry says Texas abortion bill constitutional

Gov. Rick Perry says the abortion bill awaiting his signature to become Texas law is constitutional and will withstand court challenges by those who oppose it.

Perry told reporters Saturday, hours after the bill passed, that "we wouldn't have passed it if we didn't think it was constitutional."

He said he had no timetable for signing the bill, but a spokesman for the Republican governor said it could be signed midweek.

Perry said some say the measure goes too far "but most Texans don't."

Democrats promised a legal challenge.

The law will ban abortions after 20 weeks, require doctors who perform abortions to have admitting privileges at a nearby hospital and require all abortions to be done in surgical centers.

Team Bios | Freestyle CapitalWhen Freestyle.VC co-founder and investor Josh Felser walked into the TechCrunch office a few weeks ago, you could tell something was on his mind. He was in the midst of sorting through a hiccup one of his portfolio startups was having with the Apple App Store. As we sat down, he excused himself for a few minutes to reach out to his contacts to figure out what could be done. I don’t usually find investors this consumed with tactical issues, particularly when it’s for seed-stage startups. But that’s what makes Felser and his partner in crime, Dave Samuel, distinct in the ever-growing sea of angel and seed investors. Felser and Samuel are part of an elite group of co-founders who have not only started multiple companies together but have also seen successful exits for these companies. Together, the duo started Spinner (acquired by Aol for $320 million), and Grouper (acquired by Sony for $65 million). While Samuel and Felser had been making angel investments for some time, they announced a formal $27 million fund in 2011, Freestyle Capital, which makes investments in early-stage startups. What makes Samuel and Felser?so intriguing is that they are truly entrepreneurs at heart. They are open about the fact that if they had the bandwidth, they would start another company together. But with family commitments and such, digging into a startup is difficult. So the next best thing, they say, is to help other entrepreneurs, especially at the beginning stages of building a product and business. A Lasting Partnership Felser first met Samuel at a conference in 1996. At the time, Samuel, who is an MIT grad and engineer at heart, wanted to reimagine personalized radio online through Spinner. As Samuel explains, he needed to have someone on the team with more business and sales experience, and he immediately connected with Felser. Not soon after Felser joined Samuel in 1997, their relationship was tested. An unnamed investor came between them and attempted to oust Felser from the company. Stocks go flat a day after record-breaking surge?

Stocks were mixed on Friday but but major averages rallied sharply for the week, with the Dow and S&P 500 posting their second-best weekly gains this year.

The Dow Jones Industrial Average, which had surged 1 percent to a record-breaking finish on Thursday, closed just 3 points ahead, at 15,464.30. Boeing led the blue-chip laggards, while Bank of America rose.

The S&P 500 and the Nasdaq finished higher for the seventh-consecutive session. The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, slipped below 14.

Among key S&P sectors, financials led the gainers, while industrials slipped.

Boeing slumped 5 percent following a fire on one of the company's troubled Dreamliner airliners at London's Heathrow Airport. Earlier, the airplane maker's stock had hit an all-time high at $108.15 a share.

"This is bit of an intermission but it's probably normal after some of the moves we've seen recently," said Lawrence Creatura, portfolio manager at Federated Investors.

"It wouldn't be unusual to see a bit of a pullback after this strong run, but we're in earnings season, where the results will dominate all other variables?expectations are quite low and management teams seem to have done a good job of setting the bar at ankle height, so it seems likely that we'll have more positive surprises."

Among earnings, JPMorgan Chase edged higher after the Dow component and the largest U.S. bank by deposits beat expectations on both revenue and earnings. And Wells Fargo also gained after the financial company topped the Street on both ends.

They were the first major U.S. banks to report second-quarter earnings, setting the tone for the rest of the sector which will issue results throughout next week. Earnings expectations for JPMorgan in particular were high, as the bank has beaten analyst estimates in 12 of its last 13 earnings reports.

Major averages soared more than 1 percent on Thursday, with the Dow and S&P 500 closing at record highs, boosted by assurances by Fed Chairman Ben Bernanke that the central bank would not remove its stimulus policies for some time.

On Friday, Philadelphia Federal Reserve President Charles Plosser said the Fed should wind down quantitative easing by the end of 2013. He said policy makers should treat 6.5 percent unemployment and 2.5 percent inflation targets as "triggers," not "thresholds."

On the economic front, producer prices gained 0.8 percent in June, according to the Labor Department, edging past expectations for 0.5 percent. Core producer prices, which exclude volatile energy and food costs, edged up 0.2 percent.

Meanwhile, Thomson Reuters/University of Michigan Surveys of Consumers' preliminary July consumer sentiment index fell to 83.9 from the final June figure of 84.1. Economists in a Reuters survey expected a preliminary July sentiment index reading of 85.0 compared with 84.1 in the final June report.

European shares pared their earlier gains to close slightly lower, after posting four days of successive gains. Meanwhile, the yield on Portugal's benchmark government bonds surged, following demands for a renegotiation of its bailout program.

After the European market close, Fitch slashed its credit rating on France to AA-plus from AAA with a "stable" outlook citing the country's uncertain economic outlook and the need for structural reform.

And shares in Asia traded cautiously ahead of Chinese growth data next week. China is expected to post second-quarter gross domestic product (GDP) numbers on Monday, after a slew of disappointing trade and manufacturing reports. Investors' nerves were piqued on Friday by reports that the Chinese finance minister was forecasting annual growth of only 7 percent, below the country's official growth target of 7.5 percent.

"We see no hard landing but rather steady growth. Our 7.7 percent GDP forecast is based on a stronger consumption component, making up for the slowdown in investment," wrote Steve Wang, research director at Reorient Markets, in a note.

Cubs, city of Chicago agree on Wrigley Jumbotron

CHICAGO (AP) ? The Chicago Cubs, which waited decades to install lights at Wrigley Field and has waited more than a century to win a World Series, took a giant step toward ending the wait for something every other team in the majors already has: a Jumbotron.

The city's landmarks commission, which must sign off on such plans because Wrigley is a city landmark, approved a plan Thursday to allow the team to build a first-ever electronic Jumbotron and other sign above the ivy-covered outfield walls. It did so despite objections from the local alderman, who said the signs would harm the quality of life in the neighborhood, and rooftop owners, who complained the signs will cut into their views and devastate their businesses.

The full City Council still must give its approval. Traditionally in such zoning and development issues, the other aldermen vote the way the local alderman wants. But the tradition of doing what the mayor wants is even stronger, and Mayor Rahm Emanuel clearly wants this deal to go through.

In addition, the decision might have moved the Cubs and the city a step closer to a courtroom. The rooftop owners stopped short of threatening a lawsuit, as they have done in the past, but during the hearing they talked about the tens of millions of dollars they invested in their businesses after signing their own revenue-sharing deal with the Cubs.

"They call it a see-through sign," rooftop owner Mark Schlenker said of the planned sign in right field. "I call it bankruptcy."

For his part, Ald. Tom Tunney focused on what the Jumbotron in left field would do to the neighborhood and asked the commission to imagine what a Jumbotron that is far bigger than the iconic scoreboard in center field would mean to residents right across the street.

The deal would allow the Cubs to erect a 5,700-square-foot Jumbotron in left field of the 99-year-old ball park and a 650-square-foot sign in right field.

"The Cubs often point to large signs at Fenway and U.S. Cellular. Those signs back up to expressways, not people's homes," he said.

And he said the effects of the signs would be felt farther away.

"From blocks and blocks away, the light from the proposed ... Jumbotron will flicker in living rooms and bedrooms throughout the ward," he said. He asked that the size of the Jumbotron be reduced.

The signs have long been the most contentious piece of a $500 million renovation puzzle the Cubs have been trying to put together since the Ricketts family bought the team in 2009.

The Cubs have said that they need the advertising revenue the signs will generate to help fund the renovation project that the team is paying for without public money. Team Chairman Tom Ricketts even suggested in May that he would move the team out of the iconic ball park if he couldn't build the kind of signs the team wants.

Throughout the hearing, the talk was about what the Cubs mean to the city, the fans and residents of what is commonly known as Wrigleyville. Even the commissioners expressed concern that the Cubs were risking changing the ballpark so much that fans would turn away.

"You know you don't appreciate what you have until it's gone sometimes," Commissioner Mary Ann Smith said.

But Michael Lufrano, the Cubs' executive vice president for community affairs, said the team's owners have the biggest incentive of all to make sure fans continue to visit the park.

"We don't want to change it so people won't come," he said.

Emanuel said he is pleased that another step has been taken so that the Cubs can modernize Wrigley Field and the surrounding neighborhood has the investments it needs.

"We committed to a framework of an agreement, and today puts all parties one step closer to achieving the goals set forth in that framework," he said.

Thursday's hearing underlines the fact that Wrigley, famous for the storied billy goat curse and Babe Ruth's called home run shot, is unlike any stadium in the United States.

In fact all the emotion about Wrigley was on display during the hearing that lasted nearly six hours. Supporters of the new signs echoed what Cubs officials have said: That the advertising revenues generated by the signs will help the team win and keep them from abandoning Wrigley Field.

"If the Cubs moved out of the city, it will devastate Wrigleyville," said Cecil Bernard, a neighborhood resident.

But others scoffed at the notion the signs would help turn the Cubs into winners, noting similar talk surfaced before the Cubs erected lights at Wrigley in 1988. They also told the commissioners the changes threatened a singular live sports experience shared by generations of fans.

If the City Council approves the signs, the beginning of the major renovation project could begin as early as later this year. And if the signs do go up, everyone will be watching what they do to the views from the rooftops, where owner charge people to watch the games from bleachers built atop the buildings. The team is in the middle of a 20-year revenue-sharing agreement that calls for the rooftop owners to hand over to the Cubs 17 percent of their gross annual revenue.

Cutting into their views, say the owners, amounts to a violation of their contracts with the team.

The Cubs have said the signs would have a minimal impact on the rooftops and that the views would be "largely preserved." They have pointed out that the massive left-field Jumbotron is in front of one of the few buildings that does not have rooftop bleachers.

At the same time, they've made it clear that minimal impact does not mean no impact, and if what they do to improve their business hurts the businesses that peek over their walls, so be it.

Nokia pins recovery hopes on advanced camera smartphone

NEW YORK/HELSINKI (Reuters) - Nokia on Thursday introduced a new smartphone, the Lumia 1020, with a powerful 41-megapixel camera in its latest bid to catch up with rivals Samsung Electronics Co Ltd and Apple Inc.

Tech bloggers responded enthusiastically, saying the camera quality was the highest in the market. But analysts questioned whether it was enough to help Nokia, suffering a fall in cash reserves after years of poor sales, survive.

"The hardware's a beauty on this thing," said tech website Engadget after CEO Stephen Elop demonstrated features including "floating lens" technology that adjusts for camera shake and six lenses that help produce sharper images.

The Finnish mobile phone maker is pinning its hopes for a comeback in smartphones on Microsoft Corp's Windows Phone - an operating system that is struggling to compete with Google's popular Android system.

While regular mobile phones still account for the bulk of its shipments, smartphones are viewed as crucial for its long-term survival because of their higher margins and increasing demand for web access from mobile phones.

Jo Harlow, Nokia's executive vice president in charge of smart devices, said the growing popularity of photo and video sharing meant more consumers will want better cameras.

"Taking pictures is in the top three things people do with a smartphone. It's a relevant feature to be focused on," she told Reuters. "To stand out you have to differentiate."

The new Lumia's 41-megapixel count far exceeds those of the iPhone 5 and Samsung Galaxy S4 Zoom, at 8 and 16 megapixels respectively. It is also higher than some compact cameras, although higher megapixels do not necessarily mean better photos as factors such as lens quality also affect the end result.

"The imaging capabilities here are extraordinary," said Current Analysis analyst Avi Greengart.

But he added: "It's still a Windows Phone ... if somebody is looking for applications they're still going to look at iPhone."

MARKETING PUSH

The new Lumia, which use Windows software, will be sold through U.S. carrier AT&T Inc starting July 26 for $299.99 with a two-year contract, and will be available later in other markets including China, Nokia said.

Telefonica SA, a carrier partner in European and Latin American markets, will get a version of the device, Nokia said without giving any details.

Earlier Lumia models also won positive reviews from critics and technology blogs but have failed to halt a shift to Android phones. Android and Apple's iOS together account for over 90 percent of smartphone sales, according to research firm IDC.

One major handicap has been a lack of apps. Windows Phone has only 160,000 apps, while rivals offer about five times as many because developers prefer to make them for the higher-volume operating systems.

"Despite the quality of the device, I have some serious doubts about whether it will change Nokia's fortunes, and it risks becoming a niche product," said IDC analyst Francisco Jeronimo.

He and other analysts have also said Nokia needs to step up advertising and promotion of its phones. Many have said telecom carrier partners, particularly in the United States, have failed to promote Nokia to their customers.

Elop said Nokia was pooling resources with AT&T and Microsoft to market the Lumia 1020, positive news for investors who have been worried about the company's lack of funds.

Nokia said last week that its net cash position at the end of the second quarter was between 3.7 billion euros and 4.2 billion euros ($4.7 billion and $5.4 billion), meaning it burned through as much as 800 million euros in the quarter.

"This is the first real glimmer of hope for Nokia's resurgence and the viability of the Windows ecosystem in smartphones ? provided Nokia, Microsoft, and their operator partners can convince consumers that this experience is indeed a leap forward," said Forrester Research analyst Charles Golvin. "That will be the real hard work."

I?ve long said that men who insist, at length, that women simply are less horny than men and [fill in half-witted evo psych-sounding answer] is why, they?re usually just trying to rationalize why women who hit the gym, watch their diet, do their hair every day, wear make-up, and shave extensive parts of their body then hesitate to share all that hard work with someone who combs his hair periodically and hits on women with the assumption that they owe him something. This especially includes the husbands who can barely conceal their rage at that they aren?t getting the sex from their wives they feel entitled to under the woe-is-me-why-did-biology-make-women-hate-sex exterior. I will say this: At least some ?pick-up artists? are willing to accept that women do, in fact, want sex, if they find the man attractive, even though they then still hate women for finding the ?wrong? men attractive, ?wrong? apparently being defined as ?anyone who isn?t me?. Yes, some women have lower sex drives than their male partners (and vice versa), but this narrative is much more about a man trying to avoid thinking too hard about what he could change to make sex with him more appealing, by blaming women for being biologically inadequate because of [reasons].

But until today, I never considered that the men who whine about women?s supposed brokenness in not wanting sex (with them, but they insist in general) more might actually know on some level they?re full of shit. Because Ask Polly got this ridiculous and silly letter from a man who has what he believes is an ironclad argument for why he?s entitled to cheat on his wife. Trigger warning for overwrought, annoying prose from this sample I?m sharing:

Here are the supporting facts:

1. My wife is no longer interested in sex. She is too busy and tired from stressing over the kids and delivering our little royals to their next playdate to generate biological feelings for me. Before the children were born we had a ?zestful? sexual relationship but no longer.

2. It is said men in general have a much higher sex drive. I am a man and find this to be a considerably large understatement, along the lines of saying?Transformers?might be a shitty movie.

3. I find my wife sexy; I also find other women sexy. Some of these women will have sex with me and we will enjoy it.

4. Having sex with other women will relieve much of the emotional resentment I have against my wife for her sexual indifference (even though I empathize with her), and we will have a better emotional relationship as a lack of sex will no longer be a source of conflict.

5. I will feel physically better if I have sex with other women because I will be released from the buzzing, thrumming miasma of lust that plagues me every moment during a sexless week. Believe me, most men are familiar with these feelings.

6. My wife is an outstanding mother, and otherwise a good wife and best friend.

And so on and blah blah. Polly puts him in his place, suggesting that it?s interesting that he has enough free time to do the heavy lifting required to meet women, talk them into bed, make arrangements so that his wife doesn?t find out, etc., but his wife is so insanely busy with her child-rearing duties she can?t even find the time to have a quickie with him. And you know, maybe he should fix that by, say, not making his wife do all the child-rearing. I can?t really do just to the spanking she gives him, so read the whole thing for bon mots like, ?I suggest you spend more time with your kids, and also more time thinking about what?s best for them, so the burden of stress doesn?t always rest on your wife. Find out how you can do more around the house so your wife is less sick of seeing your fat face, begging for a tuggy.?

But here?s what?s interesting to me. This guy claims to simultaneously believe:

  1. That his wife?s lack of interest in him is due to that ?known? biological inferiority of women that makes them just so less fun and lusty than men, with their life-affirming love of fucking.
  2. But she used to have sexual desire, which wanes as she?s tired, suggesting that he?s aware that women?s ?known? and hardwired lack of interest in sex is more environment than hard-wiring.
  3. That ?most men? are tortured by a ?buzzing, thrumming miasma of lust? women simply cannot understand.
  4. But that these sex-indifferent-by-biology women will nonetheless be lining up to have sex with a married man who has nothing to offer in return. Since he?s already eliminated ?relief from horniness? as something he could give women?since he clearly believes women don?t get horny?I fail to understand what he thinks he has to give women so they?ll fuck him. Does he think he?ll present a list of ?Logical Reasons You Are Obliged To Fuck Me Because I Haz A Sad?? Good luck!

So there you go. This guy clearly knows women feel sexual desire, and that it?s also possible for his wife to feel it. However, he wants her to do all the housework so he has the free time to pursue affairs, and the ?women are biologically incapable of feeling true lust? theory is simply a crutch he leans on to justify being a really horrible person. Now that my eyes are open, I?ll be listening more carefully to men who make outlandish claims about how ?females? are ?hardwired? to be sexless drones, compared to admirably lusty men who are tortured by their desires for these undeserving joyless prigs that are women.
