Lawmakers scramble for unclaimed lottery prizes

AUSTIN, Texas (AP) ? So a guy walks into a gas station, buys a scratch-off, wins a few bucks, gets distracted with some fool thing and eventually puts the lucky ticket through the wash in his Wranglers. It happens. No big deal.

But for state lawmakers in a tough budget year nationwide, the unclaimed prizes are adding up to a tempting pot of cash.

"It's something we've seen an increased interest in this year," said Jon Griffin, a policy associate at the National Conference of State Legislatures in Washington.

Around the world, some staggeringly huge jackpots have gone unclaimed in recent years, drawing lots of headlines and more than a few schemes. In 2011, a $77 million Powerball winner let the 180-day deadline expire in Georgia. In California last year, a woman claimed her $23 million prize only after state officials put on a five-month publicity campaign to find the missing winner. In Illinois, officials are still searching for the holder of a $1 million ticket set to expire on March 17. And in Britain, seven prizes worth $1.3 million each are set to expire between March and July.

After the prize deadlines lapse ?usually within a year, sometimes in as few as 90 days? lottery commissions generally put the money toward future prizes or general state revenues.

For the most part, those policies have remained unchanged since the 1960s, when the modern state lottery movement spread from New Hampshire.

"It was all divided up in terms of who gets the profit," said I. Nelson Rose, a gambling industry expert at Whittier Law School in California. "They didn't think about what's left over unclaimed."

Now, they are officially thinking about it.

In Albany, for example, a New York Senate committee is considering a proposal to transfer unclaimed prizes to a summer reading program known as the Love Your Library Fund.

In Wyoming, where lawmakers are trying to start a new state lottery agency, the unclaimed prize money has become the subject of an intricate power squabble. Members have been shading the prize legislation to change which agencies controlled the money and whose pet causes would benefit, from gambling addiction programs to assorted social needs or maladies.

Here in Texas, where even a big oil boom has not quite rescued the budget from troubles including a $4.7 billion debt to Medicaid, the unclaimed prize money seems to fit that name less and less every year.

Over the past decade, the amount has been going up, peaking at $86 million in 2010.

As the pool of cash expanded, the state developed a complex formula allowing appropriations for teaching hospitals, veterans' services and health care in border counties.

Other proposals met resistance. In 2005, one unsuccessful bill would have paid $50,000 to the families of Texas soldiers killed in Iraq and Afghanistan.

Last year, the lottery commission reported unclaimed prizes of $52 million, including $35.6 million from instant games and $16.7 million from draw games.

Though the total amounts to less than a rounding error in the state's proposed two-year budget of $88.9 billion, some strikingly diverse parties have emerged to compete for the money.

"Something like $50 million will get the legislators nuts, because they can all sense, 'That's what a school costs in my district or a bridge or a road," said William Thompson, an expert on gambling industry regulation at the University of Nevada-Las Vegas.

To Democratic Rep. Trey Martinez Fischer of San Antonio, $50 million means a chance to send some resources back to the original stated beneficiary of the state lottery, the public schools. His bill would send more to supplement school districts with low property tax revenues.

"We're still dealing with $5.4 billion in cuts that was imposed by the Republican leadership," Martinez Fischer said. "I think every dollar we can find should be going to educate our schoolchildren."

Democratic Sen. Wendy Davis of Fort Worth also kept her request on the modest side. Her bill would stake out $5 million for military veterans' health and education services. Under the current formula, those programs get a maximum of $5 million.

So far, the boldest proposal would carve out $10 million a year to restore the Battleship Texas, which is anchored at the San Jacinto Battleground in the Houston Ship Channel and draws 100,000 visitors annually.

Bruce Bramlett, executive director of a nonprofit foundation devoted to preservation of the ship, said leaks in the ship, which was commissioned in 1914, have caused damage requiring $75 million in repairs.

He said the idea of tapping unclaimed lottery money occurred to him, though he has done little to promote the proposal publicly.

"Loose lips sink ships," he said in an interview.

Republican Rep. Wayne Smith of Baytown, who filed the measure, expressed little surprise at the emergence of competition for the unclaimed prize money.

Referring to other lawmakers with rival bills, he added, "maybe they did their research too."

As budget cuts loom, is government shutdown next?

WASHINGTON (AP) ? With big, automatic budget cuts about to kick in, House Republicans are turning to mapping strategy for the next showdown just a month away, when a government shutdown instead of just a slowdown will be at stake.

Both topics are sure to come up at the White House meeting Friday between President Barack Obama and top congressional leaders, including Republican House Speaker John Boehner. A breakthrough on replacing or easing the imminent across-the-board spending cuts still seems unlikely at the first face-to-face discussion between Obama and Republican leaders this year.

To no one's surprise, even as a dysfunctional Washington appears incapable of averting a crisis over economy-rattling spending cuts, it may be lurching toward another over a possible shutdown.

Republicans are planning for a vote next week on a bill to fund the day-to-day operations of the government through the Sept. 30 end of the 2013 fiscal year ? while keeping in place the new $85 billion in cuts of 5 percent to domestic agencies and 8 percent to the military.

The need to keep the government's doors open and lights on ? or else suffer the first government shutdown since 1996 ? requires the GOP-dominated House and the Democratic-controlled Senate to agree. Right now they hardly see eye to eye.

The House GOP plan, unveiled to the rank and file on Wednesday, would award the Pentagon and the Department of Veterans Affairs with their line-by-line budgets, for a more-targeted rather than indiscriminate batch of military cuts, but would deny domestic agencies the same treatment. And that has whipped up opposition from veteran Democratic senators on the Appropriations Committee. Domestic agencies would see their budgets frozen almost exactly as they are, which would mean no money for new initiatives such as cybersecurity or for routine increases for programs such as low-income housing.

"We're not going to do that," said Sen. Tom Harkin, D-Iowa. "Of course not."

Any agreement needs to pass through a gantlet of House tea party conservatives intent on preserving the across-the-board cuts and Senate Democrats pressing for action on domestic initiatives, even at the risk of creating a foot-tall catchall spending bill.

There's also this: GOP leaders have calculated that the automatic cuts arriving on Friday need to be in place in order for them to be able to muster support from conservatives for the catchall spending bill to keep the government running. That's because many staunch conservatives want to preserve the cuts even as defense hawks and others fret about the harm that might do to the military and the economy. If the automatic cuts are dealt with before the government-wide funding bill gets a vote, there could be a conservative revolt.

"The overall sequester levels must hold," said Rep. Tom McClintock, R-Calif.

Little to no progress has been made so far between House and Senate leaders and the White House, and given the hard feelings engulfing Washington, there's no guarantee that this problem can be solved, even though the stakes ? a shutdown of non-essential government programs after March 27 ? carry more risk than the across-the-board cuts looming on Friday.

The funding plan for the rest of the fiscal year will be a main topic at the White House meeting on Friday, the March 1 deadline day for averting the across-the-board cuts.

Obama, speaking to a group of business executives Wednesday night, said the cuts would be a "tumble downward" for the economy, though he acknowledged it could takes weeks before many Americans feel the full impact of the budget shrinking.

The warring sides in Washington have spent this week assigning blame rather than seeking a bipartisan way out. In a glimpse of the state of debate on Wednesday, Republicans and the White House bickered over whether the cuts would be under way by the time Friday's meeting started. A spokesman for Boehner said they would be in place; the White House countered that Obama would in fact have until midnight Friday to set them in motion.

The cumbersome annual ritual of passing annual agency spending bills collapsed entirely last year ? not a single one of the 12 annual appropriations bills for the budget year that began back in October has passed Congress ? and Congress has to act by March 27 to prevent a partial shutdown of the government.

By freezing budgets for domestic agencies, the Republican plan would deny an increase for a big cybersecurity initiative, additional money to modernize the U.S. nuclear arsenal and money to build new Coast Guard cutters. GOP initiatives such as more money for the Small Business Administration or fossil fuels research would be hurt as well, but there's little appetite for the alternative, which is to stack more than $1 trillion worth of spending bills together for a single up-or-down vote.

But the GOP move to add the line-by-line spending bills for the Pentagon and veterans' programs to the catchall spending bill would give the military much-sought increases for force readiness and the Veterans Administration additional funding for health care.

That approach has few fans in the White House, which is seeking money to implement Obama's signature efforts to overhaul financial regulation and the nation's health care system, or within the Democratic Senate, where members of the Appropriations Committee want to add a stack of bills covering domestic priorities such as homeland security, NASA and federal law enforcement agencies like the FBI.

"You need balance," said Sen. Charles Schumer, D-N.Y. "We feel as strongly about the domestic side as we do defense."

The catchall spending measure, known as a continuing resolution or CR inside Washington, was originally seen as a potential must-pass measure to avert Friday's cuts or make them less severe. But no serious talks to avert the cuts have been under way.

On Thursday, Democrats will force a vote on a measure that would forestall the automatic cuts through the end of the year, replacing them with longer-term cuts to the Pentagon and cash payments to farmers and installing a minimum 30 percent tax rate on income exceeding $1 million. But that plan is virtually certain to be toppled by a GOP-led filibuster vote.

Republicans in turn are considering offering a measure that would give Obama authority to propose a rewrite to the 2013 budget to redistribute the cuts. Obama would be unable to cut defense by more than the $43 billion reduction that the Pentagon currently faces, and would also be unable to raise taxes to undo the cuts. The GOP plan would allow a resulting Obama proposal to go into effect unless Congress passed a resolution to overturn it.

The idea is that money could be transferred from lower-priority accounts to accounts funding air traffic control or meat inspection. But the White House says that such moves would offer only slight relief. At the same time, however, it could take pressure off of Congress to address the sequester.

In the House, where Republicans in the past Congress passed legislation to replace the cuts, Boehner has said it's now up to Obama and the Senate to figure a way out. The Senate never took up the House-passed bills, which expired when the new Congress was seated in January.

NVIDIA back with videos showing off gaming graphics at MWC 2013 ...

NVIDIA is back on their blog today about their new Tegra 4 chips, this time with information about games primed for Tegra powered devices. Games are a great way to show off the computing power of a new chip as NVIDIA demonstrates in a couple videos from Zombie Driver and RU Golf. With more computing power, graphics can display better textures and more polygons, making for smoother results. The new Tegra 4 chip will also let game developers take advantage of features like dynamic lighting to create accurate shadows.

Along with the enhancements, NVIDIA also released some information about five games that will be released soon specifically targeted at Tegra-powered devices, including:

• Burn Zombie Burn from Tick Tock Games, your typical zombie-fighting console game;
• Carie: Blood Mansion from Neowiz will include an exclusive map for Tegra device users in this action adventure game. Tegra device owners will also be able to enjoy high-res textures, enhanced physics simulations and optimized fire and smoke effects;
• RPG CODEX: The Warrior from Devclan and Playbean is an action/fighting title in which the player is battling a variety of monsters. The title will take advantage of real-time dynamic shadows and HDR lighting;
• Dead on Arrival 2 from N3V Games, another game pitting the player against zombies, this one taking advantage of high-res models;
• RU Golf from Nutgee takes the Tegra platform to a different genre where the cartoon/anime graphics take advantage of dynamic specular lighting, shadows, bloom and lens flare effects.

MARANA, Ariz. (AP) ? Bruce Lietzke would have noticed a banana inside the cover of his long putter.

One of the famous stories about Lietzke, a 13-time winner on the PGA Tour, is that he never touched a club when he wasn't on tour. His caddie didn't believe him, so at the end of the 1984 season, he put a banana inside the head cover of Lietzke's driver before zipping up the travel bag. Some 15 weeks later at the Bob Hope Classic, the caddie excitedly unzipped the travel bag.

The stench should have been the first clue.

"Sure enough, he pulled off that head cover and the banana ... it was not yellow," Lietzke said Monday. "It was black, nasty, fungus. He said he'd never doubt me again."

Lietzke confessed to breaking his own rules when it came to the broom-handled putter that he picked up at the Phoenix Open in 1991 and used the rest of his career. Even in his down time, he would tinker with the length of the putter and practice with it. And he wonders what the conversation would have been like today if that 1991 PGA Championship had turned out differently.

Lietzke was the runner-up at Crooked Stick behind a big-hitting rookie named John Daly. Imagine if Lietzke had won that major.

Would the USGA have banned the putter he anchored against his chest?

"I think so," Lietzke said. "Judging by their reaction to major successes, I guess they were just waiting for this to happen. The USGA should have made a statement then. If I had won the PGA Championship, they might have tried to outlaw it. And if you look back on it, most people would have gone along with it."

That was one of the arguments PGA Tour commissioner Tim Finchem put forth Sunday when he said the tour was against the proposed rule that would ban the anchored stroke primarily used for long putters and belly putters.

Without any empirical evidence that an anchored stroke is easier, why ban it?

And after all these years, why now?

The faces in this discussion ? and that's all it is right now ? are Keegan Bradley and Tim Clark, for vastly different reasons.

It was Bradley's win at the PGA Championship that prompted serious talk about the future of anchored strokes. Bradley now is lumped in with three of the last five major champions using a belly putter, but he was the catalyst.

European Tour chief executive George O'Grady said the conversations between golf's administrators and the governing bodies about the future of the long putters began last year at the Masters.

That was before Webb Simpson won the U.S. Open and Ernie Els won the British Open, which ramped up the attention.

As for Clark?

It was his dignified speech at Torrey Pines that led even the staunch opponents of long putters to look at them differently. More than one person in the room that night has described his presentation as a game-changer.

That much was reflected in the overwhelming support from the Player Advisory Council and player-directors on the tour's policy board that the PGA Tour should oppose the USGA on this rule.

The tricky part is figuring out where this will lead.

The PGA Tour sent the USGA a letter last week spelling out its opposition to Rule 14-1(b), and the PGA of America and its 27,000 club pros are also against the ban.

One reason Finchem decided to speak about the letter ? a small distraction during the final of the Match Play Championship ? was his concern that the discussion was being portray as a showdown. Right now, it's a matter of opinion.

If it becomes a showdown, high noon is not until the USGA and R&A decide whether to go ahead with the rule. And that decision won't come until the spring.

It's a polarizing topic. If not, the governing bodies would not have offered a 90-day comment period that ends on Thursday. They simply would have announced a new rule and been done with it.

For now, the tour has not said it will go against the USGA. It has only said it disagrees with the USGA.

Finchem chose not to show his hand when he brushed off questions about whether the tour would ever allow an anchored stroke even if the governing bodies adopt a rule that bans it starting in 2016.

But he has made clear on at least three occasions that while slightly different rules could work for the PGA Tour, this rule would not be one of them.

This is not where golf needs to go. The buzz word coming out of the USGA annual meeting earlier this month was not "bifurcation" but "unification."

Go anywhere in the world and golf effectively is played by the same set of rules. This is something that should never change.

The USGA and R&A know they don't have evidence to show that using an anchored stroke is easier. Frankly, they don't need any evidence. This is not about equipment, rather a new rule that attempts to define the golf stroke as the club swinging freely.

The mistake by the USGA was waiting until someone won a major before acting ? or believing that winning a major should even make a difference.

The majors are the biggest events to win. They define careers. But if the belly putter was an issue when Simpson won the U.S. Open, why wasn't it an issue when he won the Deutsche Bank Championship? Did the putter work differently at Olympic?

Lietzke can think of several occasions when nerves made him miss with his long putter. And if the belly putter is the cure, don't just look at Ernie Els kissing that claret jug last summer at Royal Lytham & St. Annes. Look at those two putts Els badly missed on the last few holes of the Match Play Championship to lose in the opening round.

If the USGA decides that a ban on anchored strokes is best for the game, the PGA Tour should go along with it.

And if the USGA was serious about that 90-day comment period, the hope is that it was serious about listening.

Why?

And why now?

Top GOP Voter ID Crusader Loses Virginia Election Panel Post

To those who closely follow the voter ID wars, Hans von Spakovsky is a household name, one of the nation's leading crusaders against voter fraud, and also one of its more controversial. Days before the 2012 election, The New Yorker profiled him as "the man who has stoked fear about imposters at the poll."

So it was news that von Spakovsky, a Republican lawyer and scholar at the conservative Heritage Foundation, failed to get a second term on the electoral board of Fairfax County, Virginia's largest county, despite being the top choice of the county's Republican Party.

It was the kind of local personnel change that normally wouldn't get much attention ? except that von Spakovsky has become something of a national lightning rod.

The panel of county circuit court judges who approve the political parties' nominees to the board voted to replace von Spakovsky with another Republican lawyer, Brian Schoeneman. County Democrats had accused von Spakovsky of being hyperpartisan and a master at voter suppression tactics, charges that have trailed him for years.

In an email to my request for reaction to his judicial decision, von Spakovsky, whose term ends Feb. 28, wrote:

"The 'partisanship' claim is disproved by a very simple, uncontested fact, which is reflected in the minutes of the January 10, 2013, meeting of the Board.

"I asked our clerk in December to total up all of the votes taken by the Election Board since Seth Harp, the Democratic appointee to the Board, took office. There were 224 votes taken during that time period. The Board voted 2-1 on only three issues. All remaining votes were unanimous.

"It is a bit much to claim we (or I) acted in a partisan manner on the Board when the Democratic member voted with me in 99% of all of the votes of the Board.

"But then, a majority of the judges who made this decision are Democratic appointees and they clearly made a purely partisan, political decision. They apparently don't like someone who has stood up for the integrity of the election process as I have."

According to Jay McConville, chairman of the county's Republican Party, it was the first time to his knowledge or that of those he consulted that the county's judges rejected one of the two major political parties' top choices to the electoral board. In an interview with me, he said:

"In my opinion it was the unprecedented, unnecessary and really unacceptable protest by the Fairfax County Democrats. And for reasons that are very hard to understand other than just being partisan gamesmanship. They've broken a longstanding tradition honestly because they want to show that they can. And that's really unfortunate.

"... What we care about in the Republican Party is defending the vote and free elections where qualified folks can vote. And make sure it runs well. Hans is an expert on that and he should be on the board."

Fairfax County Democrats agree that the circumstances surrounding von Spakovsky were unprecedented, though they put their emphasis not on how he is leaving the board but rather how he arrived.

Bettina Lawson, an official, said:

"What was unprecedented, actually, was the original nomination of the Fairfax County Republican Party of Hans von Spakovsky. He has a national reputation for efforts to suppress the vote with his various positions on voter identification and creating a lot of fear about voter fraud. And putting a person like that on the Fairfax Electoral Board was the original problem.

"What we did in the last three years was experience the results of that. That's why the Fairfax Democratic committee took the step of sending the letter to the judges to say, we want you to know that this man has this reputation. While he has been on our electoral board he's continued these efforts."

Von Spakovsky pushed successfully to end the practice of providing multilingual voting information in the voter registrar's office, Lawson said, a problem in a county with considerable diversity. He also succeeded in removing from the registrar's office nonpartisan informational material provided by the League of Women Voters that the county had long been made available to voters.

These and other actions made Democrats seek to permanently suppress von Spakovsky's vote on the board by getting him kicked off.

Von Spakovsky was a George W. Bush appointee to the Federal Elections Commission. But it was von Spakovsky's work before that as a Justice Department political appointee that drew the praise of voter ID proponents and ire of those opposed to the controversial laws.

As NPR's Peter Overby reported in 2007 at the time of von Spakovsky's confirmation hearing to the FEC, von Spakovsky critics accused him of, among other things, being overly partisan:

"In 2003, he worked on a redistricting plan from Texas. Tom Delay, then the most powerful Republican in Congress, drew the plan to add Republicans to the state's Congressional delegation. Career lawyers in the Justice Department said it shouldn't be approved. Von Spakovsky and other politicos thought it should be, and it was.

" ... Here are other notable cases, too. In 2005, Justice reviewed a voter identification law from Georgia. Critics said it discriminated against poor people who would have the hardest time getting photo IDs. Von Spakovsky had published a law review article arguing strongly for voter ID laws, but he'd used a pseudonym so no one connected him to it. He oversaw the review of the Georgia case at Justice and once again he overruled the career lawyers. After that career employees say there was a purge.

"... Von Spakovsky has drawn other criticism as well. At the Federal Election Commission, he declared that a proposal to regulate political advertising was equivalent to the Alien and Sedition Acts, laws that were enacted in 1798 in an effort to silence attacks on President John Adams. Proponents of stronger campaign finance regulation questioned his commitment to enforcing policies that he so clearly opposes. Von Spakovsky declined to be interviewed for this piece."
